Terms of Use

EXP0 is an online platform that allows creators to present, publish, and sell digital works (photos, videos, generative or programmable works, NFTs, etc.), and visitors to explore this content and, where applicable, acquire it. By using EXP0, you accept these Terms of Service without reservation.

1. Purpose of the Terms of Service

These Terms of Service (hereinafter the "ToS") are intended to legally govern access to the EXP0 website and the use of the services offered (hereinafter the "Platform"), published and operated by MXCOD SAS.

The ToS govern the relationships between MXCOD and:

  • Visitors who browse the Platform;
  • Artists who create an account and publish their works;
  • where applicable, Buyers who acquire works via EXP0.

The commercial terms of artwork sales are specified in separate Terms of Sale that complement these ToS.

2. Definitions

For the purposes hereof, the following terms shall have the meaning set out below:

  • EXP0: the online Platform available at https://exp0.xyz.
  • Artist: any natural or legal person with an EXP0 account who publishes works.
  • Buyer: any person who acquires a work via EXP0.
  • User: any Artist, Buyer, or Visitor using the Platform.
  • Work: any digital content (photo, video, image, audio, generative or programmable work, NFT, etc.) published via EXP0 by an Artist.
  • User Content: all content published by Users (texts, images, videos, metadata, comments, etc.).
  • EXP0 Licenses: the license models offered by EXP0 to govern the rights granted by the Artist to the Buyer for the Work (minimum 4 standard licenses).
  • Stripe Connect: a third-party payment solution operated by Stripe, allowing EXP0 to collect payments and transfer amounts to Artists.
  • Web3 Services: where applicable, any blockchain-related service (smart contracts, NFTs, external wallets, etc.).

3. Acceptance of Terms & Capacity

Use of the Platform implies full and complete acceptance of these ToS. If you do not accept the ToS, you must not use EXP0.

By creating an account, you declare that:

  • you have the legal capacity to contract under the law applicable to your situation;
  • you are at least 18 years old, or have authorization from your legal representative if you are a minor;
  • you are acting either in your own name or on behalf of a duly authorized legal entity.

Certain features (particularly sales, wallet integration, or NFT distribution) may be reserved for adult Users.

4. Description of the EXP0 Service

EXP0 allows Artists to:

  • host and present digital Works (photos, videos, interactive or programmable content);
  • create public or private collections, pages (e.g., "About", "Contact");
  • organize their Works via titles, descriptions, tags, series, captions, etc.;
  • offer certain Works for sale, under predefined usage licenses;
  • access presentation tools (thumbnails, responsive display, portfolio pages).

EXP0 allows Visitors and Buyers to:

  • view Works according to the visibility settings chosen by Artists;
  • acquire usage licenses on certain Works, in accordance with the Terms of Sale and chosen licenses.

EXP0 is not a backup service: you must keep your originals and source files (RAW, native editing files, etc.) outside the Platform.

5. Role of EXP0 & Third-Party Services (Stripe, Web3)

EXP0 primarily acts as:

  • Publisher of the Platform, providing technical infrastructure and a presentation interface;
  • Technical intermediary between Artists and Buyers, connecting supply (Works) and demand, particularly via Stripe Connect for payment management (see Terms of Sale);
  • Host of User Content within the meaning of applicable regulations.

Payments are processed by third-party providers (particularly Stripe). By using these services, you also accept their own terms of use. EXP0 does not store your credit card data.

If Web3 features (mint NFT, smart contracts, interaction with wallets) are implemented, EXP0 will not act as a custodian of digital assets: you remain solely responsible for managing your wallets, keys, and tokens. EXP0 does not provide financial, tax, or wealth advice.

6. Access, User Account & Security

Access to the public site is free. Creating an account is necessary to publish content, configure a portfolio, or sell Works.

You agree to:

  • provide accurate, complete, and up-to-date information;
  • choose a strong password and keep it confidential;
  • notify us immediately of any unauthorized use of your account or any suspected security breach.

EXP0 reserves the right to suspend or terminate any account in case of non-compliance with the ToS, risk of fraud, or abusive behavior detrimental to the Platform or third parties.

7. User Content: Rights & Licenses

7.1. Ownership — Unless expressly stated otherwise, you retain all your intellectual property rights over the User Content you publish (©, related rights, image rights, etc.). EXP0 does not claim any ownership rights over your Works.

7.2. License to EXP0 — By uploading User Content to EXP0, you grant us a non-exclusive, worldwide, revocable, transferable to technical subcontractors, royalty-free license, strictly limited to the Platform's operational needs:

  • hosting, storage, reasonable technical backups;
  • temporary reproduction and format adaptation (thumbnails, compression, video transcoding, preview generation, etc.);
  • display, making available, and distribution of your content on the Platform, according to your visibility settings;
  • where applicable, integration into EXP0's public feeds or pages (e.g., homepage, editorial showcases), always respecting your visibility settings.

This license terminates within a reasonable time after content deletion or account closure, subject to technical constraints (caches, backups), execution of ongoing contracts (e.g., sale of a Work), and retention of possible legal evidence.

7.3. Warranties — You warrant to EXP0 that:

  • you have all necessary rights to publish and, where applicable, sell the Works concerned;
  • your content does not infringe the rights of third parties (copyright, trademarks, image rights, privacy, etc.);
  • no additional authorization or compensation is due to third parties for the publication of your content on EXP0.

7.4. Generative/Programmable Content — If you publish interactive or programmable Works (for example, responding to weather, time, or external data), you remain responsible for:

  • the scripts and code used, which must comply with laws and not compromise Platform security;
  • respecting any rights over external data sources (weather APIs, feeds, etc.);
  • ensuring visual or audio outputs comply with these ToS (no illegal or offensive content).

EXP0 may, without notice, suspend a generative or programmable Work that poses a risk to the technical stability of the Platform or violates the rules below.

7.5. Reporting & Removal — Anyone can report content via abuse@exp0.xyz. EXP0 may remove or make inaccessible any content that is manifestly illegal or reported in a substantiated manner by a legitimate third party.

8. Usage Licenses for Works Offered for Sale

EXP0 provides Artists with a set of 4 standard licenses (hereinafter the "EXP0 Licenses"), describing the usage rights granted to the Buyer for a given Work (for example: personal use, editorial use, limited commercial use, advertising use, etc.).

For each Work offered for sale, the Artist must select one of the EXP0 Licenses, the text and scope of which are detailed on the Platform (dedicated license page). The Buyer is informed, before any payment, of the license applicable to the Work they are acquiring.

Unless otherwise indicated, EXP0 Licenses:

  • do not transfer intellectual property ownership of the Work to the Buyer, but grant a limited right of use;
  • do not include the right to resell source files or sublicense, unless expressly stated;
  • may govern the use of the Work in NFTs or other Web3 contexts; the Buyer must respect these limits.

EXP0 acts as a technical intermediary for connecting and documenting these licenses, but does not become a party to the license contract between the Artist and the Buyer, unless explicitly stated in the Terms of Sale.

9. Usage Rules & Moderation

It is notably prohibited to:

  • publish content contrary to law (incitement to crimes, terrorism, hatred, discrimination, non-consensual pornography or involving minors, etc.);
  • violate the privacy or image rights of third parties;
  • publish defamatory, insulting, or harassing content;
  • infringe copyrights, trademarks, designs and models, patents, or trade secrets of third parties;
  • attempt to bypass security measures or test Platform robustness without prior authorization;
  • use EXP0 to send spam, mass commercial solicitations, or malware;
  • technically exploit the Platform (mining, mass scraping, etc.) beyond normal use.

EXP0 may suspend or delete an account and/or remove any content that does not comply with these rules, without prejudice to possible legal proceedings.

10. Personal Data & Privacy

EXP0 processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable legislation. Processing purposes, legal basis, retention periods, as well as your rights (access, rectification, erasure, objection, portability, restriction) are detailed in our Privacy Policy.

11. EXP0 Intellectual Property

The general structure of the Platform, graphic elements, logo, interfaces, source code (excluding open source components used), and databases are protected by intellectual property rights and remain the exclusive property of MXCOD or its partners.

Any unauthorized reproduction, representation, modification, adaptation, extraction, or substantial reuse of the site or any of its elements is prohibited and may result in legal action.

12. Availability, Security & Maintenance

EXP0 strives to keep the Platform accessible and secure but cannot guarantee permanent availability or the complete absence of incidents. Temporary interruptions may occur due to maintenance, updates, outages, or external circumstances (host, network, attack, etc.).

EXP0 reserves the right to modify Platform features, add or remove them, at any time. Major changes will, where reasonably possible, be communicated to Users (banner, email, changelog, etc.).

13. Liability, Warranties & Risks

The Platform is provided "as is" and "as available." EXP0 does not guarantee:

  • the absence of errors, bugs, or vulnerabilities;
  • compatibility of the Platform with all hardware, browsers, or operating systems;
  • achieving any particular economic, artistic, or commercial result for Artists or Buyers.

EXP0 shall not be held liable for:

  • indirect damages (loss of opportunity, revenue, reputation, etc.);
  • data loss, subject to reasonable backups implemented;
  • content published by Users, for which they assume full responsibility;
  • acts or omissions of third-party providers (Stripe, host, weather data providers, etc.).

If Web3 services are offered, you acknowledge that:

  • blockchains are public systems over which EXP0 has no control;
  • any operation on a smart contract may be irreversible;
  • digital assets (tokens, NFTs, cryptocurrencies) are volatile and carry significant risk of loss of value;
  • EXP0 is not a custodian of digital assets and does not provide any financial or investment advice.

14. Indemnification

You agree to indemnify and hold harmless EXP0, its officers, employees, partners, and subcontractors, in the event of any claim, action, or third-party demand related to:

  • your User Content;
  • your use of the Platform in violation of these ToS;
  • any violation of third-party rights (intellectual property, privacy, etc.);
  • any breach of your legal obligations (particularly tax or social obligations).

15. Modifications to Service & ToS

EXP0 may modify these ToS at any time. The version in force is that available online at /cgu. In the event of a substantial modification, EXP0 may inform Users by any appropriate means (banner, notification, email).

Continued use of the Platform after the new ToS take effect constitutes acceptance of those ToS.

16. Applicable Law & Disputes

These ToS are governed by French law. In the event of a dispute, and failing amicable resolution, the courts with jurisdiction over the registered office of MXCOD shall have sole jurisdiction, subject to specific rules applicable to consumers.
